Abstract

Feitshans, Theodore A.. Agricultural and Agribusiness Law : An Introduction for Non-Lawyers, Routledge, 2019. ProQuest Ebook Central, http://ebookcentral.proquest.com/lib/polije-ebooks/detail.action?docID=5716862. Created from polije-ebooks on 2020-01-23 17:22:48. This book is addressed to three audiences. The first two are closely related: students in two-year associated degree programs and students in four-year bachelor degree programs. The third group that this book is intended for are farmers, prospective farmers, and those in closely allied businesses. It is hoped that this book may serve as a reference that those in agriculture may use to help to identify the questions that they need to ask of their attorneys. Legal problems, like guests that have overstayed their welcome, do not improve with age. The sooner a legal problem is addressed, the more likely is a positive outcome. Unlike fields of law such as intellectual property and bankruptcy law, agricultural law is not a unified area of law. That means that it draws from areas of law as diverse as intellectual property and bankruptcy law, often with a twist unique to agriculture. Any author coming to the topic of agricultural law will be much more versed in some topics than others. Many of these topics are very esoteric. The great challenge in writing this book has been to write in a manner that can be understood by the audiences intended for this book, while preserving accuracy. This is further complicated by the dramatic variation in laws, such as those governing the right to use water, from one state to another. If this book helps agricultural students and those already in agriculture to decide when legal assistance is needed and formulate appropriate questions, this author will consider this book a success. The second edition provides needed updates, especially for taxation and trade. It also provides a new chapter on criminal law, an area of increasing relevance to agriculture. Chapter 19 on criminal law is entirely new. While criminal law is not a new issue in agricultural law, the Justice Department has shown increased enthusiasm for prosecuting food safety cases. Chapter 23 has been substantially revised to reflect changes made by the 2017 Tax Cuts and Jobs Act. The 2017 Tax Cuts and Jobs Act is the first major revision of the Internal Revenue Code since 1986. Significant changes to Chapter 22 have been made reflecting changes made to the Affordable Care Act by the 2017 Tax Cuts and Jobs Act. The early chapters have also been reordered to move contracts up to the position of Chapter 5, reflecting the preferences of those who have been using the first edition for their classes.
